THE UNION AND ITS TERRITORY

          incidental and consequential matters

1.     Name and territory of the Union.—

(1) India, that is Bharat, shall be a Union of States.
(2) The States and the territories thereof shall be as specified in the First Schedule.
(3) The territory of India shall comprise—
(a) the territories of the States;
(b) the Union territories specified in the First Schedule; and
(c) such other territories as may be acquired.

2.      Admission or establishment of new States.—Parliament may by law admit into the Union, or establish, new States on such terms and conditions as it thinks fit.
2A. [Sikkim to be associated with the Union.] Rep. by the Constitution (Thirty- sixth Amendment) Act, 1975, s. 5 (w.e.f. 26-4-1975).

3.        Formation of new States and alteration of areas, boundaries or names of existing States.—Parliament may by law—
(a)  form a new State by separation of territory from any State or by uniting two or more States or parts of States or by uniting any territory to a part of any State;
(b) increase the area of any State;
(c) diminish the area of any State;
(d) alter the boundaries of any State;
(e) alter the name of any State:
Provided that no Bill for the purpose shall be introduced in either House of Parliament except on the recommendation of the President and unless, where the proposal contained in the Bill affects the area, boundaries or name of any of the States, the Bill has been referred by the President to the Legislature of that State for expressing its views thereon within such period as may be specified in the reference or within such further period as the President may allow and the period so specified or allowed has expired.

3         THE  CONSTITUTION OF INDIA

Explanation I.—In this article, in clauses (a) to (e), “State” includes a Union territory, but in the proviso, “State” does not include a Union territory.

Explanation II. – The power conferred on Parliament by clause (a) includes the power to form a new State or Union territory by uniting a part of any State or Union territory to any other State or Union territory.

4.      Laws made under articles 2 and 3 to provide for the amendment of the First and the Fourth Schedules and supplemental, incidental and consequential matters.—

(1)   Any law referred to in article 2 or article 3 shall contain such provisions for the amendment of the First Schedule and the Fourth Schedule as may be necessary to give effect to the provisions of the law and may also contain such supplemental, incidental and consequential provisions (including provisions as to representation in Parliament and in the Legislature or Legislatures of the State or States affected by such law) as Parliament may deem necessary.

(2)  No such law as aforesaid shall be deemed to be an amendment of this Constitution for the purposes of article 368.

The Government of India (GOI) has decided to declare WAR on its citizens by undermining their intelligence and attacking their Constitutional rights.

The Government of India and the selected (not elected) criminals in the Indian parliament in New Delhi cannot stomach the fact that dissent, and a more outspoken citizenry demanding their legal rights, enforcement of laws, equality, due process, accountability and civility from its government (Saarkar) are gathering momentum.

It is only a matter of time before UNITED CITIZENS OF INDIA (Hindus, Muslims, SikhsJains, Christians, Jews and many more) are more likely to bring law and order, civility, accountability and respect to the nation and to its democratic institutions.

A civil revolt of Himalayan proportions is inevitable if Indians get more legal rights, knowledge from the Internet, education and awareness of their region and the world in which they live in. This is the BIGGEST threat to the criminal politicians who want to keep the masses under their thumb.

Curbing free speech, expression and general knowledge only helps the criminal politicians to solidify their positions of power.

WE will not let this happen.

I am compelled to say “Free speech, is a fundamental human right and I shall have it and exercise it whenever and wherever I feel do so at any and all cost. Even if it brings death to me”.

“Free speech, is a fundamental human right and I shall have it and exercise it whenever and  wherever,

I please to do so. 

I will NOT adhere to any law that infringes upon my Constitutional right to question any authority or those who hold higher offices, this I shall continue to do so as a citizen of India at any and all cost.

No force on earth can stop me from speaking my mind, I shall continue to speak against the injustices perpetrated by the Indian Government on all Indians. Whether they may be Hindus, Muslims, Jews, Bahai, Zoroastrians, atheist, agnostic or of any caste, denomination, creed or color. For, I firmly believe in the greatest religion called HUMANITY.

No force on earth can stop me from questioning or speaking against the unjust laws or the social injustices that I and many others experience in India on a daily basis.

I am free from the shackles of intimidation and death. May God grant me HIS wisdom and strength to fight this battle against wolves in sheep clothing”.

In response to the Orwellian steps taken by the present government to curb freedom of speech and expression, which is a Constitutional right of every Indian. This law or proposition of such a law violates the Constitutionally protected fundamental right of every citizen of India.

I vehemently oppose such a law on Constitutional grounds and in the name of my beloved country. These Orwellian laws are in violation of every citizens human right to feel free to express himself or herself, without fear of punishment or reprisals from the government.

Dissent is the very basis of a democracy. May I remind you that our late Prime Minister Mrs. Indira Gandhi felt the need to curb political dissent and she achieved the same by declaring a state of emergency in India. This declaration was an effective tool for her to stay in power.

The Indian Emergency of 26 June 1975 – 21 March 1977 which lasted for a 21 month period, when President Fakhruddin Ali Ahmed, upon advice by Prime Minister Indira Gandhi, declared a state of emergency under Article 352 of the Constitution of India, effectively bestowing on him the power to rule by decree, suspending elections and civil liberties. Mr. Alok Narayan, a well-known scholar of law, called it one of India’s “blackest hours”.

The 42nd Amendment, which brought about extensive changes to the letter and spirit of the Constitution of India, is one of the lasting legacies of the Emergency. One of the consequences of the Emergency era was that the Supreme Court of India ordered that, although the Constitution is subject to amendment (as used by Indira), changes that are ultra vires to its basic structure cannot be made by the Parliament of India.

Internet Censorship in India

Internet Censorship in Indian Democracy will ONLY stifle public debates on issues, it is a TOOL THAT HELPS THE ONES IN POWER TO KEEP THE POPULATION UNDER DARK & UNDER CONTROL.

Politicians DO NOT want to be questioned, DO NOT want to be challenged, DO NOT want to be held accountable, responsible and prosecuted. This is a DIRECT ASSAULT ON THE CONSTITUTIONAL RIGHTS OF EVERY INDIAN CITIZEN.

Unite, stay united for the cause, challenge the one’s in power, question authority & be vigilant. Democracies are manipulated, subverted and democratic values and freedoms vanish giving way to tyrannies, communism, authoritarian or totalitarian regimes.
